After child custody, one of the most contentious issues in a divorce is alimony
This is largely due to the vague and ambiguous definition of alimony. Child support obligations are calculated based upon a mathematic formula [...] I recently wrote on a divorce lawyer’s discussion thread:
While it may make some feel better to suggest that divorce is nothing more than a lifestyle choice, it is not. The effects of divorce (making exception for truly abusive and/or dysfunctional relationships) are devastating, particularly for children, but by no means exclusively for children. [...] The policy should be that if anyone (man or woman) petitions for divorce without asserting (and proving) fault against the other spouse then that petitioner is rebuttably presumed unworthy of alimony, unless the petitioner can show, by clear and convincing evidence, that some equitable principle(s) dictate(s) that alimony be awarded.
