How do I get my child support money from my mother?
To clarify: My mom has been receiving child support from my Dad of $2000 per month for the past 8 years. My mom spent very little of this as it was my college fund. Now I have had a falling out with my mother and she says she is keeping all the money for herself. How do I get my money back? I am under 18 and live in NY.
If your mother was ordered to receive $2,000 per month to save up for your education as an adult and now she won’t give you the money upon you attaining adulthood, you could sue her to recover the money under a theory of third-party beneficiary.
If your mother was ordered to receive $2,000 per month to take care of you as a minor and instead of your mother spending it each month on you and your needs she hoarded it and/or misspent it on herself or on other expenses, you may have (I’m just spit balling here) a cause of action against her for breach of fiduciary duty.
