What if I don’t want custody of my child post-divorce?

If the other parent is 1) fit to exercise custody of the child(ren) and 2) willing to take custody of the children, then your desire not to have custody should be an issue that is easily resolved; the court can, upon the agreement of the parties and a petition filed with the court asking for a modification of the child custody orders, modify the child custody award and change the custody award from you to your ex-spouse. Bear in mind, however, that with the change in custody will likely come an obligation on your part to pay child support to your ex-spouse who now has custody of the child(ren).
