As a lawyer have you ever turned down a case, what was the reason?
Yes, and generally speaking, lawyers in private practice turn down cases regularly, and for many reasons. Here are the most common:
- the lawyer cannot take the case;
- doesn’t know how to handle the particular kind of case or feels another lawyer would be better qualified;
- may be too busy to take on new cases;
- has a conflict of interest with another client that prevents him/her from representing the potential new client;
- the client cannot afford the lawyer’s fee
- the lawyer does not want to handle that particular kind of case
- does not like the subject matter of the case;
- does not like the odds of winning or other things about the case;
- does not like the lawyer on the opposing side and/or doesn’t like the judge;
- the lawyer does not like the potential client or think they would be a good fit
